Trademark
Trademark is about commercial identity. Extraordinary effort and resources go into establishing a business identity in the marketplace, something that will identify a business’ goods or services and help distinguish a business from the pack. This is where trademark comes in. A trademark whether it be a name (e.g., Coca-Cola, Arctic Cat, Levis), a symbol (e.g., the McDonald’s golden arches or the Nike swoosh), a saying, sound, color, or something else identifies a business and sets it apart from its competitors. On occasion, a trademark can be the most valuable asset of a business. Trademarks enable a business to capitalize on the goodwill established with consumers through a track record of providing excellent goods and services. Similarly, trademarks are also sometimes used to thwart legitimate competition in situations where the trademark itself is either narrower than the owner believes or lacks a sufficient position in the marketplace.
